All products we offer are legal in the Netherlands. We do not provide information about the legal status of our products in other countries. You are solely responsible for complying with local laws and regulations. You confirm that importing the ordered products into your country is permitted. By placing an order with 420shop, you accept full responsibility for the legality of the product in your country.

Our cannabis seeds are intended exclusively for personal and small-scale use. We do not supply seeds, nutrients, or cultivation materials to large-scale or commercial growers. If we suspect that an order does not comply with these terms, we reserve the right to refuse it.

420shop does not claim that the information and products on this website are suitable, legal, or available outside the Netherlands. All information on our website, through links to other websites, or provided via email, phone, or other means, is for educational and informational purposes only. This information should never be interpreted as a recommendation to take specific actions. Using our information for illegal purposes is entirely at your own risk. As a customer, you are fully responsible for any personal damage, criminal consequences, loss of income, loss of property, or other consequences arising from the (mis)use of products purchased from us. 420shop, its owners, employees, and representatives cannot be held liable for customers’ actions.

Article 1. Definitions

In these terms and conditions, the following terms shall have the following meanings:

  1. Nabi Media B.V.: The private limited company Nabi Media B.V., established at Konijnenberg 127 (4825BC) Breda.
  2. Buyer: The natural person or legal entity who purchases products from Nabi Media B.V. or instructs Nabi Media B.V. to perform work and/or services.
  3. Consumer: A buyer who is a natural person and does not act in the exercise of a profession or business.
  4. Offer: Any offer of products and/or services, including associated conditions, made available to the buyer by Nabi Media B.V. via the website, brochures or in any other means.
  5. Price: The price of the product or service offered, excluding any additional costs, unless stated otherwise.
  6. Inspection period: The period within which the consumer can exercise his right of withdrawal.
  7. Duration transaction: a distance contract concerning to a series of goods and/or services, the delivery and/or purchase obligation of which is spread over a certain period.
  8. Dispute Committee: The Dispute Committee Thuiswinkel, Postbus 90600, 2509LP Den Haag.
  9. 420shop: The webshop owned by Nabi Media B.V. and operated by Nabi Media B.V. via http://www.420shop.nl.

Article 2. Applicability

  1. These general terms and conditions apply to all agreements, offers, and quotations of 420shop. Any (general) terms and conditions of the buyer are explicitly excluded.
  2. General (delivery) conditions of the buyer are expressly rejected.
  3. Upon request, the buyer will receive a copy of these general terms and conditions free of charge.
  4. If 420shop deviates from these terms and conditions at any time, whether temporarily or permanently, implicitly or explicitly, this does not mean that the buyer can derive any rights from this. 420shop reserves the right to require strict compliance with these terms and conditions at any time.
  5. If any provision of these general terms and conditions (or of an agreement with 420shop) conflicts with mandatory law or an applicable statutory regulation, the conflicting provision shall be null and void. In that case, it will be replaced by a legally valid provision that, as far as possible, corresponds to the original provision in content.

Article 3. Formation of Agreements

  1. All offers from 420shop are without obligation.
  2. An agreement is only concluded after 420shop has accepted an order. 420shop reserves the right to refuse orders or impose additional conditions on delivery, unless expressly agreed otherwise. If an order is refused, 420shop will inform the buyer within ten working days, stating the reason.
  3. Orders via the webshop www.420shop.nl are only permitted for persons aged 18 years and older. By placing an order, the customer declares that he or she is at least 18 years old or acts with the consent of a legal representative.

Article 4. Prices and Payments

  1. After the conclusion of the agreement, prices will not be increased, except as a result of changes in VAT rates or other legal regulations. For products with variable prices, this will be stated in advance, including the indication that these are reference prices.
  2. If a price increase occurs, the consumer may terminate the distance contract on the day the price increase takes effect.
  3. Outside existing agreements, 420shop reserves the right to adjust prices, for example due to legal obligations.
  4. All prices are in euros, including VAT and excluding shipping costs and any other charges, unless stated otherwise or agreed upon in writing.
  5. Unless otherwise agreed, payment must be made in advance by bank transfer to 420shop’s account. Payment is made without discount or set-off.
  6. In case of bankruptcy, suspension of payments, or guardianship of the buyer, all outstanding claims of 420shop become immediately due and payable.
  7. Payments will first be applied to costs, then interest, and only afterwards to the principal sum. 420shop may refuse payment if the buyer wishes to apply a different allocation. Full repayment of the principal sum may also be refused if the associated interest and costs are not paid.
  8. If an advance payment has been made and the agreement ultimately does not come into effect or is terminated (as referred to in Article 7, paragraph 8), the prepaid amount will be refunded as soon as possible, but no later than within 14 days.

Article 5. Collection Costs and Default

  1. If the buyer fails to pay the agreed price in full on time, they will automatically be in default without notice of default from the moment the payment term has expired. From that date until the day of full payment, the buyer owes a contractual interest of 1.5% per calendar month on the outstanding amount. Any part of a month is counted as a full month.
  2. All costs incurred to enforce payment—both judicial and extrajudicial—are entirely at the buyer’s expense. If the buyer fails to meet their (payment) obligations, they are required to reimburse the extrajudicial collection costs. These costs are set at a minimum of 15% of the outstanding amount, with a minimum of €37.00.

These costs include, among others:

  • Sending reminders and warnings
  • Consultation and correspondence with the buyer
  • Investigation into an amicable settlement
  • Investigation into the possibilities of recovering the claim
  • All other costs incurred to obtain payment

These collection costs are separate from any further costs such as bailiff fees, court fees, and lawyer’s fees, which a judge may assign in a ruling.

Article 6. Delivery

  1. Unless otherwise agreed, delivery takes place from the warehouse or wholesaler of 420Shop. The buyer is obliged to accept the ordered products as soon as they are available or offered to them.
  2. If the buyer refuses to accept the order, or does not provide (correct) information or instructions needed for delivery, the products will be stored at the buyer’s expense and risk. Any additional costs resulting from this will be charged to the buyer.
  3. If 420Shop needs certain information from the buyer for delivery, the delivery period only starts once this information is fully provided.
  4. Products in stock are generally shipped within 7 days. 420Shop executes accepted orders with reasonable speed, no later than within 14 days. If a delivery is delayed, for example because an item is temporarily out of stock or can only be delivered partially, the buyer will be informed no later than one month after ordering. In that case, the buyer may cancel the order free of charge. If payment has already been made, the amount will be refunded as soon as possible.
  5. Any stated delivery time is indicative and not binding. Delivery times are therefore not strict deadlines. 420Shop reserves the right to temporarily postpone delivery if market conditions require it.

Article 7. Inspection Period and Right of Withdrawal

  1. If the delivered products do not match the agreement, the buyer must report this to 420Shop as soon as possible. The buyer is obliged to inspect the products immediately upon receipt and report any defects or incorrect deliveries in writing right away.
  2. For distance purchases (such as via the webshop), there is a minimum inspection period of 14 days unless otherwise agreed. This period starts the day after the product is received by or on behalf of the consumer. The purchase is only final after this period ends.
  3. During the inspection period, the consumer has the right to withdraw from the purchase. This means the consumer can decide to return the product or cancel the service without giving a reason. Only the direct costs of returning the product are at the consumer’s expense. For services, the same reflection period applies under the same conditions.
  4. If there are exceptions to the inspection period, for example due to the nature of the product, this will be clearly stated with the offer.
  5. The consumer can only exercise the right of withdrawal by sending a message to 420Shop within 14 days after receipt. This can be done in writing or by email.
  6. If the consumer exercises the right of withdrawal, 420Shop will refund any paid amount within 14 days.
  7. The consumer may only use the right of withdrawal if the returned products are complete, undamaged, unused, and in their original packaging. The consumer must return the package within 14 days after notifying the withdrawal. Return shipping costs are for the consumer.
  8. If an inspection period applies, exercising the right of withdrawal automatically counts as termination of the purchase agreement.

Article 8. Retention of Title

  1. All products delivered by 420Shop remain the property of 420Shop until the buyer has fully paid all outstanding amounts. This applies to everything agreed in the contract, including any additional costs or damages due to failure to comply with agreements.
  2. If the buyer resells the products as a reseller, this is allowed as long as it happens in the normal course of business. If the buyer creates something new from these products, that new product also remains the property of 420Shop until full payment is made. In that case, the buyer holds the product on behalf of 420Shop.
  3. If rights are granted or transferred, this always happens under the condition that the buyer pays the associated costs on time and in full.
  4. 420Shop may hold goods such as products, rights, documents, data, or results of a service, even if there is an obligation to hand these over, as long as the buyer has not paid in full.
  5. The buyer may not establish rights on products still owned by 420Shop. If a third party tries to do so (e.g., seizure), the buyer must immediately inform 420Shop.
  6. The buyer must handle all products still subject to retention of title as carefully as their own property.

Article 9. Force Majeure

  1. In case of force majeure, 420Shop may choose to temporarily suspend the order or terminate the agreement entirely. This may be done without court intervention. The buyer will be informed but is not entitled to compensation unless it would be clearly unreasonable in the specific situation.
  2. Force majeure includes situations in which 420Shop cannot fulfill its obligations due to circumstances beyond its control. Examples include natural disasters, strikes, supplier failures, or government measures. In such cases, responsibility does not lie with 420Shop.

Article 10. Warranty

  1. The warranty in this article is in addition to the rights the buyer already has under the law.
  2. If a product does not meet the warranty and this is not the buyer’s fault, 420Shop will ensure replacement or repair within a reasonable time after the product has been returned or the defect reported. 420Shop decides whether the product will be replaced or repaired. If replaced, the buyer must return the old product, which then becomes the property of 420Shop again.
  3. The warranty does not apply if the product was damaged due to improper or incorrect use. Nor if the buyer or others have modified or attempted to repair the product without 420Shop’s permission.
  4. For products and electronic devices, the warranty period set by the manufacturer always applies. 420Shop never provides more warranty than the manufacturer does.

Article 11. Liability

  1. 420Shop is not liable for damages caused by the use of products purchased via 420Shop, whether directly or indirectly.
  2. If a product does not meet the agreements and this is seen as a manufacturing defect, 420Shop is not responsible for consequential damages.
  3. 420Shop is not liable for errors or delays in communication (such as via the internet) between you and 420Shop or between 420Shop and third parties, unless there is intent or gross negligence by 420Shop.
  4. The products sold by 420Shop are not intended to treat, cure, or prevent diseases or physical or mental complaints.
  5. Do not use certain products if you have high blood pressure, cardiovascular disease, diabetes, or other physical complaints; are pregnant or breastfeeding; use medications such as MAO inhibitors; plan to drive or operate (heavy) machinery; suffer from nervousness, insomnia, loss of appetite, tremors, palpitations, or other complaints. When in doubt, always consult a doctor first and follow their advice.
  6. By placing an order with 420Shop, you accept full responsibility for the (il)legal status of the products you have delivered.
  7. If you order for delivery outside the Netherlands, you must check yourself if the products are allowed in that country. You are responsible for knowing the laws there.
  8. You, as the customer, are fully responsible for injury, damage, fines, loss of income or property due to purchase, use, or misuse of products via 420Shop. You indemnify 420Shop against all claims or damages.
  9. Information on the website, via email or phone, or through links is only general information. It is not advice and should not be used as a basis for actions. Use at your own risk. Information may be incorrect or outdated.
  10. Always keep products purchased via 420Shop out of the reach of children.

Article 12. Complaints and Disputes

  1. If you are not satisfied with a product or service, please let us know as soon as possible, preferably by email to contact@420shop.nl. We will respond to your complaint within 14 days.
  2. If we cannot resolve it together, you can submit your complaint to the Dutch Home Shopping Disputes Committee (“Geschillencommissie Thuiswinkel”) for a fee of €25, P.O. Box 90600, 2509 LP The Hague. More info at www.sgc.nl. This committee handles complaints independently. Its decision is binding. If you win (partly), you get your complaint fee (partly) refunded.
  3. You can also choose to bring the dispute before the competent court.
  4. Complaints about purchases or services can be submitted to the Disputes Committee by both you and 420Shop, provided the rules below are met.
  5. The committee will only consider a complaint if you first reported it to us within a reasonable time.
  6. You must also notify the Disputes Committee in writing within three months after submitting the complaint to us.
  7. If you want the Disputes Committee to handle the dispute, 420Shop must agree. If 420Shop wants to submit the dispute to the committee, you must respond within five weeks whether you agree or prefer the court. If you do not respond within five weeks, 420Shop may bring the dispute before the court.
  8. The Disputes Committee issues a decision according to its regulations. This decision serves as a binding advice.

Article 13. Applicable Law and Dispute Resolution

  1. All agreements you make with 420Shop are governed exclusively by Dutch law. The Vienna Sales Convention of 1980 does not apply.
  2. All disputes, even if only one party considers it a dispute, arising from or related to such an agreement, will be submitted to the competent court in the place where 420Shop is established, unless the law provides otherwise.
  3. 420Shop and the customer may also agree to have the dispute handled by an independent arbitrator instead of a judge.
